This is only what I can get from your detailed post. Forgive me if I miss something. 1.)Burden is always on the state so if they’re counting on circumstantial evidence they may be in trouble. Even if she seems absolutely guilty, that’s not how it works. Gotta go on the evidence. There was a big murder trial here and the defendant was found guilty but, on appeal, they had some evidence dismissed and all the prosecution had was circumstantial evidence. He walked. Shouldn’t have but he did. I agree with you that circumstantial cases can get make some headway but it’s tough. Burden is on the state. Scott Peterson was a great analogy though. 2.)To your “accidental murder” point. Maybe manslaughter is the direction the prosecution should go. I wonder if they ever offered her a deal? Take man 1 or man 2 and avoid a trial for murder. Maybe the prosecution thinks it has a strong case. If not, she walks and they can never touch her again. Both sides are always risking a lot in a trial. But I think we have a relatively good justice system. As good as men can make something anyways. 3.)There are the details of her life after the death of her daughter but what about before? What do they have to make a jury believe she woke up one day and decided to kill her child? I guess that’s what all the crazy family testimony was about? What motive did she have, other than this “reset button”? Will that be enough? I guess we’ll see. But you lay out a pretty good case against her. An interesting and exciting historical period. It really was mankind’s “coming of age” after the Renaissance. Never before had scientific thought strayed so far from familiar religious doctrine. It’s where many of the scientific theories we know today really began to take shape. And I too feel it’s influence is lost in time. Maybe we look around at our modern, automated world and think we are still in the midst of some enlightenment period. Perhaps many think we know what we need to know already. It’s also about how we inform our citizens. How many think U.S. textbooks are adequate? I sometimes think history is regional. Every place has a different version. You eve read a book on the Founders printed outside this country? You totally get a different story. I believe in the old saying, “The winners write the history books”. Rome referred to the conquered as “savages” and “barbarians”. That was the belief for centuries. Today we know they were just as culturally advanced as Rome. They just didn’t have the money to build decadent monuments to their awesomeness. The European world pats itself on the back for it’s “great discoveries” during the Renaissance and Enlightenment, but they were treading familiar ground already laid out by Arab and Chinese thinkers. It was the Arab world that brought the West out of the Dark Ages. Shared their profound scientific advancements with them. And that’s America to me. Born on third base thinking we hit a triple. A country dominated by half truths masquerading as fact. If we’re3 doing it right, then the Enlightenment Era never ended. We will still question and still demand proof. The irony of all of it is that most of our great thinkers from the past were wealthy men. Or at the very least lived quite comfortably. They were the only ones with the money and free time to pursue these things. That was another great thing about the Enlightenment. it began to elevate a middle class. To prioritize education for all. To create the circumstances that would allow a future patent clerk from Zurich to become the most famous scientist in history. There will be a new age of Enlightenment. Don’t know exactly when, but it’s coming. Information has never been more available and more and more households are getting access to it everyday. We have to learn to fail before we can learn to succeed though. The people won’t fail though. They never have. Never said they “liked” cheating. Just that we don’t care. You may, most don’t. So, I see nothing “anecdotal”. Anyways, that’s a silly argument. Let’s get to the meat of it. I never said those moral philosophies were the same. I just said it was what I believe in. To protect the needs of the many, sometimes things must be done that we don’t want to do. That’s all I’m saying. We have to kill thousands of Afghanis and Pakistanis to feel safe. It’s the needs of the many. By any means. Jefferson made many quotes about many things. I find it hard to believe he would not apply the same limits to his own country that he would to another. Funny thing about the Founders though, they started a “revolution” so they wouldn’t have to pay taxes. It’s not like I revere them or anything. But I do appreciate rebellion. And the outcome of the Civil War was very much inevitable. The South NEVER had a chance to win that war. The worst case scenario was forever fracturing the union. But the South had no chance. And speaking of history. I did not realize Rome and Imperial Britain had satellites. Or ICBMs that travel hundreds of miles. A mechanized force that allows the end of conscription and gives the populace a lust for constant war. I guess I’ll have to reread the history books. We were NEVER a lone superpower. We have NEVER ruled the world. IF Rome had OUR army. OUR tech. They still would. They had no qualms regarding genocide and total war. We very much do. And I justify “the ends” with the phrase “The road to Hell….”. “Great” men have attempted to do “great” things and been so terribly wrong about it. Men whop were so “right”, so sure they knew what was best. So ready to talk down to anyone who disagreed. I spit on those men. They can do what they think is “right”. I prefer what is necessary. It’s a gift, as Malcolm X said. But so often it is misplaced. I think people need to get angrier at themselves. I’m amazed sometimes by the people on this site. People who know who they are and are so comfortable with it. I’m a little jealous actually. They know. Sure they’re angry but, most often, they’re angry about the right things. I often disagree on the particulars but I cannot deny the message. Most of us just don’t seem to know what we want. I don’t think people have had anything forced on them. Or made to suffer through it. We brought it on ourselves. We’re angry but just what are we angry about? Do we even know? I sure as shit don’t anymore. I knew very little about economics before I came to this site. I think that showed in my posts! The more I learn, the more I think we just don’t know what we’re after. We’re just being blindly led by rage. Rage is no good. It’s never productive. Most of us have nothing to be angry about. Most of us are employed. Most of us have or will receive some kind of health coverage. Despite falling wages we’re still some of the best paid workers on Earth. Where’s the focus? Where’s the stance that actually means something? They just pick us off in small groups and count on us having no organization to prevent it. So far it’s working pretty good.
