It was Senate bill 256, the Bankruptcy bill that was passed in 2005 that suddenly stood out in my mind. Looking back to 2005 I remember thinking; “Why now?” “Why this?” Why would a bankruptcy bill be passed with such speed and haste? Why would any exceptions for individuals be stripped out by the GOP, but exceptions for corporations allowed to stay? Is the GOP simply malevolent? What’s going on? Well in 2009 I got my answer to why banks and credit card companies were blitzing Congress with bales of money and lobbyists: They knew what was coming. Credit card companies realized they had given a card to everyone and their mother and that they were overextended in their hunt for more profit. Banks knew that they had made questionable loans and created questionable investments. Their answer? Make sure that when the collapse came that consumers were still going to be forced to pay them. No exceptions for medical debt, no exemptions for the elderly to stay in their homes, no exemptions for victims of identity theft, no exemptions for those serving in active duty overseas, no exemptions for someone who just lost their job. However trusts are exempt, so the wealthy can pile all of their money into trust and then declare bankruptcy, and corporations were rescued by the Senators from Delaware (where over 50% of corps are domiciled) who realized that if corps were forced to declare bankruptcy in the state they operate in, that Del would lose tens of millions in fees.
