So let’s split hairs here.
Their isn’t any tax in the ACA, there are penalties for not getting HC insurance that will be collected through the IRS, the governments revenue collection arm.
Even if the authority of the individual mandate had been given under the commerce clause, the penalties would have been collected by the IRS, no difference but since the SCOTUS said that the individual mandate was legal under the right to tax, the R’s are now calling it a tax. There wasn’t any change, it was and is a penalty whether it’s commerce or ability to tax.
Like I say it may be splitting hairs but Dems would be better off calling it what it is, a penalty, and not let the R’s propagate the use of the word tax. Don’t let them go there!

Some observations:
They all agreed that justice Ginsburg’s opinion was by far the best, that her upholding the use of the commerce clause was sound and legal.
The Dissents were weak in both the use of the commerce clause and striking down the whole law.
No one could understand Roberts argument striking the use of the commerce clause and why he went with the taxing authority.

He also brought up the point that the mandate came from that librul thin tank ‘The Heritage Foundation’ and was pushed as a conservative talking point of personal responsibility. But since we know that black men have no personal responsibility and we have one in the WH, it has to be an evil librul plot.

Most of the GOP do as why the economy is under-performing. Remapping Debate reported on hearings that were held to list all the regulations that blocked or slowed business and few to none actually were in effect, it was the “the uncertainty” fed by GOP.
