I have a few comments: First, because you are attorney and because this is legal advice, I’ve decided to stop paying off my credit cards. Thanks. Second, the moral stigma of bankruptcy is one that Americans need to shake. Two events occurred that turned the issue of bankruptcy for an individual from a moral quandry into a business decision. One: The breakdown and final removal of Glass-Steagall. With Congressional and administration help the banks finally won. Utterly and completely. They had an eight-lane freeway to all of the risk, fees, and exotic financial instruments they wanted. It fundamentally changed the nature of lending, and banking into something we had never ever seen before. The individual and small business who does business with those banks was swept up into the maelstrom, most none the wiser that they were riding the tiger. The second event was the afore-mentioned Bankruptcy Abuse Prevention and Consumer Protection Act of 2005. If there was EVER a more cynical, corrupt, nasty bill passed passed by our Congress in the last 100 years I am at a loss as to what it was. The banks KNEW this meltdown was coming someday, they KNEW American were leveraged to the hilt with their complicity, the KNEW that there was no way they would EVER collect on all of this debt, so what did they do? They made it harder for Americans to exercise their legal escape hatch from bad luck, bad judgement, bad timing, and the debtor’s prison of “payment arrangements”. Once this monstrosity was passed, all bets were off. The remaining social contract between lenders and borrowers was finally rent irretrievably. We had some friends call us last night from Pennsylvania. Husband is employed as a truck driver full-time. Wife has had her hours cut at her job to five hours a week. Due to his medical issues, they took out a second mortgage to try to get on top of his medical bills. They finally after 3 years of living like slaves to this debt got approval to declare Chapter 13, eliminating their second mortgage and getting the medical debt crammed down to $40k. Their response was exactly what I was hoping for. No shame, no conflicting emotions, but simply grim satisfaction that maybe, just maybe they could have a life again. Is their credit affected for the future? Sure. Do they care? Nope. They just want to stay in their house, buy some clothes for their kid and pay their medical bills. That is nothing to be ashamed of. Doing it on purpose? Damn right. Will it wreck the credit markets? Maybe. Is it a GOOD idea? I really don’t know. Is it a FAIR idea? I would have been surprised if CLASS had stayed as part of the law. Most Americans are reluctant to purchase private long term care insurance regardless of cost because of the uncertainty around a couple of issues: 1) Premiums can and have gone up significantly on LTC policies over the last several years as nursing home and home health care costs have skyrocketed 2) Insurers (like MetLife) are bailing out of the industry because of the their inability to forcast their liability and costs accurately 3) The fact is that you only have a 50% chance you’ll ever collect on the Long Term Care policy, which turns people off. Chronic illness is the number 1 cause of bankruptcy (voluntary or involuntary) in our country, and family caregivers currently provide $19 billion dollars of unpaid care per year. THIS is the issue that will sink Medicaid. We are now much healthier as a populace, which mean we tend to NOT pass away when chronic illness strikes, but rather it lingers for years and years. I saw that interview and had a lot of conflicting emotions about it too. They gave me a lot to think about and some excellent historical context to inject into my thoughts. Thanks for posting those. Cesca’s refrain is a familiar one, and one we’ve explored here numerous times. I’m starting to cement a theory in my mind about this topic. Are the “firebaggers” and the like lazy? Here’s what I mean. I think many liberals, my wife included, built up Obama as an avatar, a symbol of the change that was now going to sweep away the bad times and start ushering in a more liberal, progressive, tolerant, peaceful “good time”. They pinned their hopes on him, worked for him, send money to him, and like me, exulted when he won the election. When it became clear that the system, the Congress, Obama’s own moderate leanings, his administration were obstacles to the liberal version of “how things should be” many felt disillusioned, frustrated, and in some circumstances, betrayed. But all of the anger and accountability and action seems to be focused on what Obama needs to do, what Congress needs to do, rather than focused on building up change from the bottom up. Instead of finding MORE liberal candidates to fill school boards, precinct chairs, judgeships, city council seats, the lazy left focuses on ‘top-down’ change rather than ‘bottom-up’ change. These are the people that spend all of their energy and time begging people to vote for Nader or McKinney or any third party candidate because the other two are “the same”, thinking that if they get angry enough, write and complain enough, that 30 years of political drift and voter habits will be reversed in 4. I think that makes them lazy, maybe just naive. This is a generational fight that all of us need to be prepared to put just as much energy into as the right has for the last 30 years. They have systematically infected and taken over the levels of power on a local and state level all over the country. The 2010 elections were their signal to pounce.
