It is more like 100%. That makes Biden’s comment that 10% -15% of Americans are not very good people a tad short as well. Those people are still Americans and humans, and like their actions and attitudes or not, we have to love them. Bless their hearts. But we don’t have to ignore their actions and attitudes, nor do we have to allow them to control our government or our society. » Posted By TOCB On June 5, 2020 @ 7:29 am Steve Schmidt on trump’s unlawful order to the U.S. military.
» Posted By TOCB On June 5, 2020 @ 6:14 am Never did I dream that troops taking that same oath [to defend the Constitution] would be ordered under any circumstance to violate the Constitutional rights of their fellow citizens — much less to provide a bizarre photo op for the elected commander-in-chief, with military leadership standing alongside,” Mattis wrote in a statement to journalists on Wednesday. The LAW does not require military personnel to obey unlawful orders. 10 U.S.C. §836 ¶14 b(2)(a)(i): An order requiring the performance of a military duty or act may be inferred to be lawful and it is disobeyed at the peril of the subordinate. This inference does not apply to a patently illegal order, such as one that directs the commission of a crime. EVERY member of the U.S. military, from the Secretary of Defense to a Basic Trainee or even the lowest level of the ROTC SHOULD be able to recite the First Amendment from memory. An order to violate the First Amendment is CLEARLY a patently illegal order. NO ONE in the military should obey such an order. EVER!!! The order trump gave to forcibly remove peaceable protesters from Lafayette Park, so trump could stage a photo op by holding a Bible upside down CLEARLY violates the First Amendment right of peaceable assembly. Amendment I Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances. I understand that nothing will be done to hold trump accountable for anything. He actually thinks he can stand in the middle of Fifth Avenue and shoot someone, and Senate republicans would say it was justified. He was impeached for clearly committing high crimes and misdemeanors, and Senate republicans said he should remain in office. Brees said during an interview with Yahoo Finance he “will never agree with anybody disrespecting the flag of the United States of America or our country” when asked about players possibly kneeling during the anthem to bring awareness to social injustice, as Colin Kaepernick did in 2016, during the 2020 season. https://www.nfl.com/news/drew-brees-apologizes-for-comments-on-flag-disrespect To Drew Brees and Donald Trump and anyone else who don’t understand the difference between symbols of freedom and justice, as opposed to ACTUAL freedom and justice. I served on active duty in the U.S. military. I DID NOT put my life on the line to protect a symbol of freedom and justice for ALL citizens of The United States of America, although it was an honor to do that as well. But more importantly, I put my life on the line to protect the citizens of the United States of American from losing our freedom and justice. That freedom and just includes the CONSTITUTIONAL RIGHT of free speech and peaceable assembly (redress of grievances against the government). Collin Kaepernick did not only have a RIGHT to peacefully protest police brutality by taking a knee during the national anthem, indeed he and you and trump have an obligation to place ending police brutality OVER singing the national anthem or saluting the American flag, BECAUSE when we allow police brutality of ANY citizen, regardless of race, creed or color THAT IS WHEN WE DISHONOR THE NATIONAL ANTERM AND THE UNITED STATES FLAG!!!
» Posted By TOCB On June 4, 2020 @ 10:19 am I FEEL like something is different this time. I HOPE George Floyd is the LAST involuntary martyr for racial injustice in the United States and socioeconomic injustice on Earth. When I see SO MANY young people protesting (mostly peacefully) this murder, and so many chiefs of police and public officials openly acknowledge that this has been going on for over FOUR HUNDRED YEARS in the United States, AND it is TIME to CHANGE, I am ENCOURAGED. I think this DIFFERENT reaction to the murder of George Floyd is because the Earth has changed. The Earth did not change a week ago. It changed several years ago, and now MOST of the people on Earth are changing to align with the new vibrational light Earth is receiving. Earth is a living organism that is constantly evolving, just as every living organism on Earth is constantly evolving. At some point in the last thirty of forty years, Earth evolved to a fourth density planet. What that means is that the vibrational light received by our planet is no longer a vibration that supports selfishness and power over other-selves. The fourth density vibration is one of love and compassion, and that vibration is what is causing people who could not see what Black Lives Matter meant two or three months ago, not only see it today but they FEEL it. SOMETHING IS DIFFERENT THIS TIME. » Posted By TOCB On June 2, 2020 @ 5:25 am We often hear it said that the Logan Act has never been enforced. A logical question to that statement is WHY. The law was passed in 1799 and it addressed the relationship that Thomas Jefferson and the Democratic-Republican Party had with France versus the relationship the Federalist Party had with Great Britain. Some scholars characterize the law as a partisan law. I think it is a very legitimate law that is more important today than it was in 1799, especially as it has been violated by modern day Republicans. During the Obama administration, Tom Cotton orchestrated a meeting between Republican senators and the Iranian government in an attempt to undermine the negotiations between the Iranian government and the Obama administration related to Iran acquiring nuclear weapons. It could be argued that Republican senators, as members of the United States government, are authorized to discuss government affairs with foreign governments, although it is probably dangerous to use that authority to undermine the executive branch of the government. In 2016 after trump won the presidential election with help from the Russian government, for trump and Flynn to discuss sanctions imposed against Russia by the current U.S. government BEFORE trump took office was the most egregious violation of the Logan Act in American history. I recall trump saying that Flynn did not do anything wrong. OF COURSE trump lied. He even said that although he did not instruct Flynn to talk to Russia, Flynn was just doing his job. This is WAY MORE SERIOUS than the press or Mueller, and for certain the trump administration responded to this very egregious violation of this law. 18 U.S. Code § 953 Any citizen of the United States, wherever he may be, who, without authority of the United States, directly or indirectly commences or carries on any correspondence or intercourse with any foreign government or any officer or agent thereof, with intent to influence the measures or conduct of any foreign government or of any officer or agent thereof, in relation to any disputes or controversies with the United States, or to defeat the measures of the United States, shall be fined under this title or imprisoned not more than three years, or both. This section shall not abridge the right of a citizen to apply, himself or his agent, to any foreign government or the agents thereof for redress of any injury which he may have sustained from such government or any of its agents or subjects. » Posted By TOCB On May 30, 2020 @ 6:46 am I am encouraged for the growth toward unity of the USA when I see young people of all ethnicities protesting the murder of George Floyd. I am disappointed that some of them are violently protesting and burning businesses that support their own well-being. “What I see happening on the streets of Atlanta is not Atlanta. This is not a protest. This is not in the spirit of Martin Luther King, Jr. This is chaos,” an impassioned Lance Bottoms said at a news conference. “A protest has purpose. When Dr. King was assassinated, we didn’t do this to our city,” she said. “If you want change in America, go and register to vote. … That is the change we need in this country.” And there will not be a first degree murder charge against Chauvin, because he did not commit first degree murder. Ben Crump should know that. In most states, first-degree murder is defined as an unlawful killing that is both willful and premeditated, meaning that it was committed after planning or “lying in wait” for the victim. https://criminal.findlaw.com/criminal-charges/first-degree-murder-overview.html Most of us understand the frustration communities have for policemen who murder the people they are suppose to serve and protect, and even those who have committed crimes. Policemen are not the judge, jury and executioner of suspects. Policemen are also subject to the laws they are charged with enforcing. However, nothing is gained from SENSELESS destruction. » Posted By TOCB On May 30, 2020 @ 5:30 am To support a third-degree murder charge, prosecutors don’t have to show the killing was intentional. But they need to prove beyond a reasonable doubt that the officer caused the death by acting with a “depraved mind without regard for human life,” according to Minnesota law. The video alone may not be enough evidence to secure a conviction, said Richard Frase, a criminal-law professor at Minnesota Law School in Minneapolis. He said prosecutors will have to argue that Mr. Chauvin, who has been fired from his job, knew that pressing his knee against Mr. Floyd’s neck could have deadly consequences but didn’t care. IF Mr. Chauvin didn’t know that applying pressure on Mr. Floyd’s neck for nine minutes would not cause his death, he would be the only adult in the world who did not know that. And the video clearly shows that Mr. Chauvin did not care if Mr. Floyd died as a result of applying pressure to his neck. If those are the conditions of a conviction, I would say Mr. Chauvin gets convicted. » Posted By TOCB On May 29, 2020 @ 5:34 pm Killing someone without justification INHERENTLY violates their civil right to live. This IS NOT rocket science. Legal experts are saying that although video clearly shows the officers caused George Floyd’s death, it is hard to prove that they intended to kill him. This is what the law says. This law DOES NOT require for a police officer to know that his unnecessary deadly force would cause the death of a suspect. This is especially and obviously applicable in the Eric Garner case as well as in the George Floyd case. Neither Garner or Floyd posed any threat to the officers of anyone else. Neither of them were armed and neither of them resisted arrest. Both of them told the police that they could not breath. In the case of Floyd, even the bystanders were telling the police that they were killing Floyd. § 1047.7 Use of deadly force. (1) Self-Defense. When deadly force reasonably appears to be necessary to protect a protective force officer who reasonably believes himself or herself to be in imminent danger of death or serious bodily harm. (2) Serious offenses against persons. When deadly force reasonably appears to be necessary to prevent the commission of a serious offense against a person(s) in circumstances presenting an imminent danger of death or serious bodily harm (e.g. sabotage of an occupied facility by explosives). (3) Nuclear weapons or nuclear explosive devices. When deadly force reasonably appears to be necessary to prevent the theft, sabotage, or unauthorized control of a nuclear weapon or nuclear explosive device. (4) Special nuclear material. When deadly force reasonably appears to be necessary to prevent the theft, sabotage, or unauthorized control of special nuclear material from an area of a fixed site or from a shipment where Category II or greater quantities are known or reasonably believed to be present. (5) Apprehension. When deadly force reasonably appears to be necessary to apprehend or prevent the escape of a person reasonably believed to: (i) have committed an offense of the nature specified in paragraphs (a)(1) through (a)(4) 1 of this section; or (ii) be escaping by use of a weapon or explosive or who otherwise indicates that he or she poses a significant threat of death or serious bodily harm to the protective force officer or others unless apprehended without delay. 1 These offenses are considered by the Department of Energy to pose a significant threat of death or serious bodily harm. (b) Additional Considerations Involving Firearms. If it becomes necessary to use a firearm, the following precautions shall be observed: (1) A warning, e.g. an order to halt, shall be given, if feasible, before a shot is fired. (2) Warning shots shall not be fired. If authorities want to do something to prevent the conditions under which violent protest occurs in Minneapolis, they could simply arrest the men who killed Floyd. Again, it is NOT rocket science. https://www.youtube.com/watch?v=FTd5RmxopjU » Posted By TOCB On May 29, 2020 @ 10:39 am “But my job in the end is to prove that he violated criminal statute and there is other evidence that doesn’t support a criminal charge. We need to weigh through all of that evidence and come through with a meaningful determination and we are doing that to the best of our ability.” The phrase “…there is other evidence that doesn’t support a criminal charge…” is what drew the criticism. His office later released a statement saying that the quote was taken out of context and in terms of an investigation, it is critical to look at all evidence in the case because at the time of trial, all evidence will be used. https://kttc.com/2020/05/28/hennepin-county-attorney-makes-statement-on-george-floyd-case-clarifies/ Country Attorney Freeman says his comment was taken out of context. He also said that police officers are allowed to use necessary force but not excessive force. The problem with his statement is that there is no evidence of necessary force. Floyd was clearly murdered and it was captured on video. What other evidence is needed to arrest the officers for murder and accessory to murder? Every minute these officers are not arrested is a minute in which law enforcement of Minneapolis is complicit to violence that is committed as a result of the officers not being arrested. An indictment is a necessary and vital part of due process. The officers’ right to due process is not violated because they are arrested for what evidence reflects is a murder. A trial will either clear them of charges or convict them. THAT is due process!!! » Posted By TOCB On May 29, 2020 @ 3:56 am The crooked idiot who is the so-called president of the USA? “Republicans feel that Social Media Platforms totally silence conservatives voices,” the president tweeted Wednesday without providing evidence, adding that the companies should either be “strongly” regulated or shut down. On Tuesday, Twitter hit Trump with a fact-check for the first time ever, for tweets the president wrote claiming that mail-in ballots are rife with fraud: “Get the facts about mail-in ballots,” the note below Trump’s tweet said. Hours later, the president responded by accusing the company of “interfering” in the 2020 election, stifling free speech and using “fact-checking by Fake News CNN and the Amazon Washington Post.” It probably never occurred to trump that what he is basically saying is that he wants to censor those who he claims censors him and his merry band of idiots. How did the social media censor trump, according to him? They fact-checked him. Yes, it is censorship to fact-check the president. The delay for the global advisory is the latest reported example of the strained relationship between the agency and White House throughout the pandemic. Six mid- and higher-ranking staff members at the CDC expressed their discontent to the news outlet. “We’ve been muzzled,” a current CDC official told the network. “What’s tough is that if we would have acted earlier on what we knew and recommended, we would have saved lives and money.” This is not from Democrats or “fake news outlets”. It is from the CDC, which reports to trump. At this point it doesn’t matter what trump does or says about keeping Americans safe from this pandemic. It is up to US! If you think it makes sense to conduct yourselves as if it is safe to return to normal activities, that is YOUR choice. It is not trump’s decision, or the state and local government’s decision, or your employer’s decision. It is YOUR decision. It is being reported that China is experiencing a new outbreak of the virus. Trump complained that China initially attempted to hide the virus. Apparently, they are no longer doing that. I suspect both religious people and atheists would have a problem with this for many reasons, one of which is that it says that not only does God (The One Infinite Creator) exist, but it is the ONLY thing that exist. So-called Christian conservatives would REALLY have a problem with The Law Of One because it places their belief system in the category of “service to self”, as opposed to “service to others”. Neither category is necessarily negative, but service to self can be negative energy which will inevitably lead to negative karma. » Posted By TOCB On May 20, 2020 @ 5:23 am “You know what the crime is.” Trump literally doesn’t know his arse from a hole in the ground. It is also against the law to lie to the FBI about such negotiation, or about anything for that matter. Yes, trump has the power to pardon Flynn, but the attorney general does not have the power to dismiss a criminal conviction, as that is the authority of the court, notwithstanding the very serious damage such a dismissal does to the rule of law. Just as Barr “interpreted” the Muller Report to say that it completely exonerated trump, now he has “interpreted” an FBI report to claim the FBI admitted to trying to entrap Flynn. Barr and trump’s merry band of idiots are like the gang that couldn’t shoot straight. Didn’t they know that Congress and the press would read the Mueller Report for themselves? Didn’t they know that FBI officials were not going to sit back and allow their boss to smear them? Department officials reviewing the Flynn case interviewed Bill Priestap, the former head of F.B.I. counterintelligence, two days before making their extraordinary request to drop the case to Judge Emmet G. Sullivan. They did not tell Judge Sullivan about Mr. Priestap’s interview. A Justice Department official said that they were in the process of writing up a report on the interview and that it would soon be filed with the court. The department’s motion referred to notes that Mr. Priestap wrote around the bureau’s 2017 questioning of Mr. Flynn, who later pleaded guilty to lying to investigators during that interview. His lawyers said Mr. Priestap’s notes — recently uncovered during a review of the case — suggested that the F.B.I. was trying to entrap Mr. Flynn, and Attorney General William P. Barr said investigators were trying to “lay a perjury trap.” That interpretation was wrong, Mr. Priestap told the prosecutors reviewing the case. He said that F.B.I. officials were trying to do the right thing in questioning Mr. Flynn and that he knew of no effort to set him up.
