In order to secure the 270 electoral votes needed to win the presidency, Romney would need to nearly run the table of swing votes. We all agree that this is a terrible law for any number of reasons: Wild West anarchy, the ridiculous ability of someone to falsely claim they were threatened—or even FELT threatened, etc. But I’ve been wrestling with it from a legal angle. (PPOV needs a resident lawyer!) For one thing it allows local government to shirk their most basic responsibility of protecting its citizens by unofficially “deputizing” anyone to act as the police. It says in effect, “Since we can’t be everywhere to protect you, you protect yourself. And we’ll take your word for it.” Of course, they don’t even provide any training or guidance—in Florida, they even promise not to prosecute you! So right there, it seems to me that can’t be “legal.” While I am unsure how to explain why the law is wrong legally, I do know that there are federal laws which supersede state laws– Hate crimes being the pertinent one in this case. And I think that’s why the DOJ became involved. The Feds can’t really interfere in a commonplace murder investigation –no matter how badly bungled–unless there is something about it that touches upon Federal law. And then it struck me. (I was looking on Wiki for something on the Commerce Clause.) This is the 14th Amendment– ratified during Reconstruction. In it is The Equal Protection Clause: The Equal Protection Clause can be seen as an attempt to secure the promise of the United States’ professed commitment to the proposition that “all men are created equal”[2] by empowering the judiciary to enforce that principle against the states.[3] The Fourteenth Amendment Equal Protection Clause applies only to state governments, but the requirement of equal protection has been read to apply to the federal government as a component of Fifth Amendment due process. More concretely, the Equal Protection Clause, along with the rest of the Fourteenth Amendment, marked a great shift in American constitutionalism. Before the enactment of the Fourteenth Amendment, the Bill of Rights protected individual rights only from invasion by the federal government. After the Fourteenth Amendment was enacted, the Constitution also protected rights from abridgment by state leaders and governments, even including some rights that arguably were not protected from abridgment by the federal government. So my question is, doesn’t the Equal Protection Clause apply for Trayvon Martin? How is it possible for this man to be convicted, but not Zimmerman?
