He is not an American citizen or legal resident. He has to go back to Japan to renew his visa periodically. (incidentally, he has said a number of times that the earthquake was “nothing” and shrugged it off) He is considered the same as if a private home owner was to hire someone to paint their house. No taxes. He pays by the job, which means no accounting for hourly wages; there is no minimum wage in the situation. Technically, under Federal law, being required to stay on the premises 24 hours would entitle me to pay for the full 24 hours. Even Walmart recognizes this and pays accordingly. I told my buddy, that I was working with (not for), that I would not go back unless days off were worked out in advance, had keys to come and go during off hours as I please, and was informed what I was getting paid and when. Last week, I had 20 hours with my partner, and was unable to go with my partner to three important appointments. He had to drive himself, and he is not comfortable driving my van at all, much less in heavy traffic. Sunday night, I literally had less than an hour’s warning that we were coming back. The owner was supposed to meet us Monday morning here at home for some work on the property we rent from him, and he never showed up. That’s typical. He screams and yells about things that have to be done “right now”, and five minutes later can’t be bothered to acknowledge the job is done, or materials are needed to do the job at all. If I was still getting unemployment, those benefits would be canceled right now. First, I worked a job, but not for the 90 days necessary to start up benefits again. Second, I have basically refused a job. You are not allowed to refuse a job when on unemployment. Good thing I don’t get it anyway, then. Thanks for caring. I just quit my job. I told the guy I was working with that I will not be going back up to Seattle. The boss likes to pit workers against each other for his amusement, there is no set pay or set payday, days off are canceled or postponed without warning, and I was not allowed to have a key to the apartment we were staying in or the building, so I had to stay there on my hours off unless I was accompanied by another of the guys. And what I was paid is not enough for the stress and chaos.
